Barton residents Bert and Deanna Gallison have appealed a zoning permit amendment granted to their neighbors John and Olivia Alford for a yurt on Willoughby Lake Road. The appeal, filed with the town's Development Review Board, argues that Zoning Administrator Sarah Bailey overstepped her authority by approving a setback deviation.
The Gallisons contend the amended permit allows a structure that violates dimensional setback requirements from the property line, and that only the Development Review Board, not the zoning administrator, has the legal authority to grant such deviations. The two families have been in dispute over the Alfords' property development, including allegations of tree cutting and stream alteration.
The case is the latest in a series of complaints the Gallisons brought to the Barton Selectboard before filing the formal appeal.
